So, our homeowner's association hired an off duty police officer to drive thru the subdivisions and scan car tags. We have a vehicle that has an expired tag, but it does not get driven. We use my truck.
We got a letter from the HOA stating that we have to park the car in the garage (where it can't fit) or face fines. The HOA covenants state that there are to be no unlicensed vehicles in the driveway. The car is insured, it's just has not had a current tag in a couple of years. It has mechanical problems that have not been fixed.
Is it legal for an off duty (or even on duty) police officer to scan tags of vehicles in a private driveway?
