With everything we know about jurors, why do people insist on letting them in the courtroom?
I have a proposal that I haven't found anyone else advocating. We conduct the trial before impaneling the jury. Opening and closing arguments are submitted in writing. The whole trial is conducted without the jury. The transcript is then redacted for all comments stricken from the record.
Then, we impanel the jury. They are given the transcript and the evidence, and then reach a verdict.
