Upon the receipt of the verified signatures from the state or district involved, of 10% of those who voted in the election of the senator or member of the house of representatives, that member shall be subjected to a recall election within 30 days. If the representative is recalled by popular vote (50% plus 1 vote), then that office shall be emptied, and a new election to fill the office run within 60 days of the recall. The recalled individual shall not be eligible to run for this seat until the time of one full term has elapsed. If the individual is not recalled, he or she shall be immune to recall for 1 calendar year or the end of his or her term, whichever is shorter.
