A US Federal judge in has approved the requirement in the state of Florida that skim milk be labelled as "imitation milk product" where no vitamins are added to it. Since 2012 the Florida Department of Agriculture has required the labelling. The case was taken in 2014 by Ocheesee Creamery who was told to label its skim milk as "Non-Grade A Milk Product, Natural Milk Vitamins Removed" because the company wasn't adding vitamins to make up for the nutrients lost when the fat was removed from the milk. The dairy claims that the government requirement violates it's First Amendment rights and "forces it to mislead customers".
The state argues skim milk has to have the same nutritional value as whole milk in order to be classified as milk.
"Consumers take for granted the nutritional value of skim milk without even knowing that the vitamins have been restored" according to the judge in the case.
An appeal is planned.
