Governments and Law

Should Governments be held to account if the effects of a law or behaviour created by a law cause unintended harm to any of its citizens, where that harm was not foreseen. Also when that harm has become apparent and the government does not repeal the law or move to act in some way to stop the harm, is the Government more or less liable. I am thinking here of some of the laws around the world in the cases of Mental Health, Care in the Community but there are probably many more examples.
