Who will replace Scalia?

OK, Scalia is still dead. The next phase is to name a successor. Of course, the President will do that, despite Republican whining that he shouldn't.

Initially, the name that was popping up was Sri Srinivasan, who was recently approved unanimously for the DC Appeals Court. But now the rumor is AG Loretta Lynch. It's an interesting move. She has a track record as a prosecutor, and among the actual legal criticisms I've heard is that she has been pro-big business and soft on white collar crime as a prosecutor. Not an ultra-liberal, that's for sure.

Another thing she has for her is that she was just approved by the senate for AG, so she has been vetted extensively. It wasn't a slam dunk like Srinivasan, but Mitch McConnell was among those who voted for her.

And then there is the political issue, that she would be the first African-American woman on the Supreme Court. Yeah, it's political, because it puts the republicans in a political corner, either to approve her or come out against the black woman. Legal issues aside, there's a potential fallout.

Personally, I wouldn't be surprised if she was nominated, and the senate rejected her. And I don't think the White House would be surprised, either. However, fortunately, if that happens, they swoop in an put up Sri Srinivasan, and the right is relieved and approve him easily. Obama is happy, because he was always content with Sri Srinivasan as the judge, and the voters still get to see the republicans trashing the black woman.
