Is retribution really the proper aim of society? Don't get me wrong. If someone can't be rehabilitated, they should be locked up, possibly for life, where they can do no harm. But their confinement should be as humane as possible, I believe.
My view may not be as far-out as you may think. As society gets more humane and moral, and pays more attention to human decency, punishments get less brutal.
An eye for an eye and a tooth for a tooth, we still say. But if, say, someone rapes and tortures a woman, we don't punish him by having him raped and tortured. Think about it. Brandings, dismemberments and drawing and quartering were all common in the English common law system of justice in the past. But we don't do these things anymore. Why? Again, think about it.
