Attempted to arrange kidnapping of witness to crime - not guilty of anything

The High Court has determined convicted Canberra paedophile Aaron James Holliday did not break the law when he encouraged a fellow inmate to arrange the kidnapping of witnesses in his upcoming trial.

Holliday, 31, is serving an eight-year sentence for sex offences against three young boys, but the High Court was asked to decide on other charges levelled against him.

Originally, Holliday was also convicted in the ACT Supreme Court of plotting to have witnesses in his trial kidnapped and then forced to retract their evidence.

He had typed an eight-page document detailing the plan, and enlisted a fellow prisoner to arrange its execution through a third party.

However, the man instead went to authorities and the kidnapping never happened.

Holliday was found guilty of incitement to kidnap and attempting to pervert the course of justice and sentenced to an additional 30 months jail.

But he won an appeal against the incitement charges after arguing that as the kidnapping never took place, the fact that he incited the other man to assist him was not illegal.
