If forced, Obama should do a recess appointment

Senate Leader Mitch McConnel says he will NOT allow a vote on a new Supreme Court Justice to fill Scalia's spot, till Obama leaves office.

Not only is this highly partisan, but its damn petty.

There is ZERO precedent for waiting till the next President to fill a Supreme Court vacancy.

5 times over the last century, a new Supreme Court Justice was approved during the sitting President's last year in office.

The Constitution says nothing about lame duck presidency.

It says the President shall nominate a Supreme Court Justice when a vacancy exists, and the Senate shall investigate the guy/gal.

By refusing to question and vote on Obama's nominee, the GOP-run Senate will be abdocating and ignoring their Constitutional duties.

However, I think Obama should play McConnel's game, and make a Recess Appointment until the next Congress is brought in, if the Senate refuses to do their duty.

This is perfectly legal, and makes sense.

The flip side is that if the GOP does refuse to question and vote on a SCOTUS nominee, it will make them look horrible, and will be great ammo for the Democratic Presidential nominee in November.
